Agreement Overview

This End User License Agreement ("Agreement") is a legal agreement between you and Pixel Mariner ("Service", "we", "us") governing your use of the Pixel Mariner file-sharing platform. By accessing or using our service, you agree to be bound by these terms.

1. License Grant

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Upload and share files through the Service
• Access files shared with you via valid URLs
• Use the Service for personal or commercial purposes

2. Acceptable Use

You agree NOT to use the Service to:

• Upload illegal, harmful, or infringing content
• Distribute malware, viruses, or malicious code
• Violate intellectual property rights
• Harass, threaten, or harm others
• Circumvent security measures or abuse the platform
• Share content depicting child exploitation (zero tolerance)

3. Content Ownership

You retain all ownership rights to content you upload. By using the Service, you grant us a limited license to store, encrypt, and deliver your content as necessary to provide the Service. We cannot access your encrypted files and claim no ownership over your content.

4. Service Limitations

• File size limits: 100MB per file for anonymous users, 5GB for premium accounts
• Expiration: All files expire based on view count or time limits
• No backup guarantee: We are not responsible for data loss
• Availability: Service provided "as-is" with no uptime guarantees

5. Privacy & Encryption

Files are end-to-end encrypted. We cannot decrypt, access, or recover your files. The decryption key is in the share URL and never transmitted to our servers. You are solely responsible for protecting share URLs—anyone with the URL can access the file.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Pixel Mariner shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service, including data loss, business interruption, or unauthorized access to shared files.

8. Indemnification

You agree to indemnify and hold harmless Pixel Mariner from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of this Agreement.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice, for violations of this Agreement or any reason we deem necessary to protect the Service or other users.

10. Changes to Terms

We may modify this Agreement at any time. Material changes will be posted on our website with a 30-day notice period. Continued use after changes take effect constitutes acceptance of the new terms.

11. Governing Law

This Agreement is governed by the laws of the jurisdiction where Pixel Mariner is registered, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration.
